Terms and Conditions

(Please read the following terms and conditions carefully, as they specify our respective rights and obligations. Once you begin your ride, tour, shuttle service, excursion, activity, or any other service with Digger Adventures, L.L.C. [also known generally as Digger Adventures] and/or any of our affiliate(s), named or unnamed, you agree to accept these terms and conditions by default.)

Once ‘Digger Adventures, L.L.C.’ confirms your booking or agrees to provide you and/or your party a ride, tour, shuttle service, excursion, or any other service, a contract is made between ‘Digger Adventures, L.L.C.’ and you upon the terms and conditions set forth below. ‘Digger Adventures, L.L.C.’ hereinafter referred to as ‘we’, will only confirm your booking once we have received payment in full for your tour or other anticipated service to be provided.

1. Booking

-After full payment is received, you will be allocated a place/places on the specific date and time of your sightseeing tour. A confirmation will be emailed to you. This is the only confirmation of booking you will receive. Print and save your confirmation of booking for your own reference.

-Once you begin your tour or service, you agree to accept and abide by these terms and conditions.

-We accept no responsibility for incorrect email or inability to deliver email. If your confirmation does not arrive in a timely manner, or at all, then you must contact us and ask us to resend the email confirmation of the tour(s) and/or services you have paid for.

-All booking made on the internet will be confirmed via email.

-We reserve the full right to sell any seats that have been reserved for which we have not received full payment (or a deposit amount deemed acceptable).

-It shall be the responsibility of the passenger to check and confirm the accuracy of the date(s) booked immediately upon receipt of travel documents.

-Any internet bookings made after 8:00 pm for the following morning cannot be guaranteed by Digger Adventures, L.L.C.

2. Insurance

-Travel insurance coverage is not included in the ticket price.

-We take no responsibility for any injuries, loss, or death to you and/or your guests that may be incurred whilst you are taking part in any ride, event, shuttle service, tour, activity, or any other service. We strongly recommend that you obtain comprehensive insurance coverage for trip cancellation, medical expenses, personal accidents, personal baggage, money, and public liability before you travel or embark on any trip, ride, or activity. You may not be accepted as a ‘Digger Adventures, L.L.C.’ passenger unless you have arranged for, and obtained, satisfactory insurance coverage.

-We accept no responsibility for any theft, loss, or damage to personal belongings at any time during the duration of your tour, ride, excursion, event, shuttle service, activity, or any other service.

3. Cancellation and Refund Policy

-You may be entitled to a full refund only if you give us a minimum 24-hour notice of your intention to cancel.

-If you cancel your day tour within 24-hours you can choose to change your departure to another date (subject to availability).

-If you are traveling on any of our day tours and have booked via our website, http://www.inserturlofDiggerAdventureLLC.com, all terms and conditions are the same.

-If you are late for the bus in the morning, or are a no-show, you will be fully charged for the tour that you have booked with us as we have reserved a seat or seats for you.

4. Changes by Us

-We reserve the right to change our itineraries at any time and at our discretion. As professionals, we endeavor to avoid this. If a change is necessary, we will substitute alternative arrangements of comparable monetary value.

-We reserve the right to alter our itinerary in the event of events or happenings outside the control of Digger Adventures, L.L.C. These include, but are not limited to,: floods and weather conditions, outbreaks of contagious diseases, illnesses, pestilence, and/or viruses, revolution, national or local strikes and/or protests, social disorder, and political unrest.

-We constantly strive to make our tours the best they can be; Therefore, should attractions open or become available to us that we believe will enhance your experience of our beloved West Virginia and/or the surrounding region, then we reserve the right to include these in accordance with your best interests.

-We reserve the right to change the price of our tours at any time.

-We reserve the right to release amended brochures, advertisements, pricing, and marketing, into the public domain at any time.

5. Traveling

-You must obey the laws of the United States of America, West Virginia, and all local cities, towns, municipalities, townships, unincorporated areas, and populated places, whilst traveling on and off our routes. We ask you to show respect to the customs and cultures that exist in West Virginia. If you do not do so, you may be asked to surrender your ticket, which may be cancelled without any refund. It is our representative who will decide to cancel your pass or not, and their decision will be final.

-Your appointed Digger Adventures, L.L.C. Tour Guide may need to make a decision in the interest of safety. It is a condition of booking that you comply with the authority and decisions of the appointed representative of Digger Adventures, L.L.C. If you do not comply with the said representative and are not compatible with the general enjoyment and well-being of members of the tour, we reserve the right to refuse to allow you to continue the tour. In such a case, we will not be liable to issue any refund, compensation, or any additional costs that may be incurred by you. We cannot accept liability for the behavior of others on your tour, nor if any facilities are curtailed as a result of their actions.

-It is your responsibility to meet your tour at arranged points. Because of the nature of the service, Digger Adventures, L.L.C. will not be liable if any service leaves or arrives later than its specified time, even if as a result you miss any connecting service. Digger Adventures, L.L.C. will endeavor to ensure that departure and arrival times are met.

-You are responsible for dressing appropriately for your tour and weather conditions, which may include closed-toe shoes or boots, jackets, hats, gloves, rain or cold weather gear, umbrellas, etc.

6. Your Obligations and Responsibilities

-You must inform us in writing of any medical condition that requires attention or medication before your tour commences.

-It is your responsibility to have any and all necessary travel documents, which may include proper identification, visas, passports, permits, and certificates, required for your selected itinerary, as well as any necessary vaccinations, and to comply with all applicable laws.

-During your tour, your tour guide may take photographs, films, digital recordings, and/or images of you (as part of a group) while you are a passenger, and these may be used in our groups, brochures, and/or advertising and publicity material without obtaining any further consent from you, or providing any payment or compensation to you in respect of, or regarding, such materials.

-When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss must be paid at the time of the occurrence directly to the accommodation owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims (including legal costs) subsequently made against Digger Adventures, L.L.C. as a result of your actions.

-You are obliged to respect the right of residents living close to any stops made while on tour.

7. Complaints

-In the highly unlikely event that you may wish to make a formal complaint against Digger Adventures, L.L.C., please inform the Digger Adventures, L.L.C. Driver/Representative at the time. If the matter cannot be resolved immediately, or during your trip after the Driver/ Representative’s best endeavors to do so, your complaint should be made in writing to Digger Adventures, L.L.C. as soon as is reasonably possible after the tour, but within 30 days thereof so that your complaint can be investigated. Digger Adventures, L.L.C. will not consider any claims after the 30-day period. You will be assured of respect and courtesy whilst your complaint is being dealt with.

8. Weather Conditions

-Under no circumstances can we be held responsible for weather conditions. No ticket can be cancelled or amended by you at any time on the basis of weather conditions. We accept no responsibility for weather conditions that may affect the delivery and implementation of our itinerary.

9. No Smoking Policy

We do not permit smoking on any of our vehicles.

10. General

-The booking conditions detailed herein contain the entire contract between you and Digger Adventures, L.L.C. No representation, term, warranty or condition can be expressed or implied by reference to any other writing, advertisement or conversation. This contract may only be varied in writing by a duly authorized officer of Digger Adventures, L.L.C.
This contract and all matters arising out of it are governed by United States law. We both agree that any dispute, claim, or other matter which arises out of, or in connection with, this contract, or services provided, will be dealt with by the Courts of the United States of America only.

-Changes to these Booking Conditions will only be valid if agreed to by Digger Adventures, L.L.C. in writing.

-Every effort is made to ensure the accuracy of our brochures and other printed and digital material at time of going to print or live publication; However, Digger Adventures, L.L.C. cannot be held responsible for printing and typographical errors, or changes in the itinerary arising from unforeseen circumstances after the material has gone to print or publication.
